Terms of Use

This is an English translation for convenience. In case of any discrepancy, the German version prevails.

1. Provider and Scope

The provider of the PRIZMA service is Igor Zelikovsky, Digitalkin AI (trade name), Bleicherfeldstraße 31, 33689 Bielefeld, Germany. PRIZMA is an automated content creation and publishing platform. By using the service, you accept these terms.

2. Businesses Only

The service is directed exclusively at businesses (Unternehmer within the meaning of § 14 BGB — self-employed individuals, freelancers and companies) and not at consumers (§ 13 BGB). By using the service, you confirm that you use it in the course of your commercial or independent professional activity. A consumer right of withdrawal therefore does not apply.

3. Access and Account

Access to PRIZMA is not granted through open self-registration but on request. After you get in touch, you go through an individual onboarding process (setup, guidance and, where applicable, a trial period); access is enabled only afterwards. You agree to provide accurate information and are responsible for the security of your account. One account is provided per organization unless otherwise agreed.

4. Acceptable Use

You agree to use PRIZMA for lawful purposes only. The following are prohibited:

• Creating content that violates applicable law or the rights of third parties
• Using the platform to distribute spam or harmful content
• Attempting to hack or disrupt the service
• Reselling access to the service without our permission

5. Your Content

You retain all rights to content you upload to PRIZMA. By providing materials, you grant us a limited license to process them solely for the purpose of delivering the service. We do not use your content to train AI models without your explicit consent.

6. Intellectual Property

The PRIZMA platform, its design, algorithms, and source code are our property and are protected by intellectual property law.

7. Payment and Plans

Payment terms are determined by the selected subscription plan. All prices are exclusive of any applicable statutory VAT. Payment is made in advance.

8. Limitation of Liability

PRIZMA is provided "as is." We are liable without limitation for intent and gross negligence, and for injury to life, body or health. In cases of simple negligence, we are liable only for the breach of a material contractual obligation (cardinal obligation) and limited to the foreseeable damage typical for this type of contract. Any further liability, in particular for indirect damages, loss of profit, or outcomes arising from the use of generated content, is excluded.

9. Termination

You may discontinue use of the service at any time. We reserve the right to suspend or terminate access in case of violation of these terms.

10. Changes to Terms

We may update these terms. We will notify you of material changes by email at least 14 days before they take effect.

11. Governing Law and Jurisdiction

These terms are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). The exclusive place of jurisdiction for all disputes arising from or in connection with these terms is Bielefeld, provided the customer is a merchant, a legal entity under public law, or a special fund under public law.
